The petitioners apprehend arrest in connection with Saur Bazar Police Station Case No. 218 of 2017 dated 13.05.2017 registered for the offence(s) punishable under Section(s) 147, 149, 341, 323, 324, 308, 354, 448, 427 of the Indian Penal Code. The petitioners and the informant are resident of same place. It is alleged that on the date of occurrence quarrel took place between the children and subsequently, the family members scuffled in which the informant sustained injury. There is also a
Patna High Court Cr.Misc. No.39441 of 2017 (2) dt.19-08-2017 counter case lodged by petitioner no. 2. The injury report of all the injured appears to be simple in nature.
Learned Additional Public Prosecutor opposed the aforesaid submission.
Considering the facts and circumstances, as stated above, this application for anticipatory bail is allowed. Let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saur Bazar Police Station Case No. 218 of 2017 dated 13.05.2017, subject to the condition as laid down under Section 438 (2) of the Criminal Procedure Code.
