JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-11-2020 Heard learned counsel appearing on behalf of the petitioners; learned counsel appearing on behalf of the State as well as learned counsel for the informant.
The petitioners, who are ladies, are in custody in connection with Sahebpur Kamal P.S. Case No.75 of 2020 for the offence under Sections 147, 148, 149, 341, 326, 307, 302 and 504 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioners submits that there is no specific allegation of assault against these petitioners who are said to be associates in commission of crime. Learned counsel further submits that in fact, on the day of Holi, the
Patna High Court CR. MISC. No.27205 of 2020(2) dt.02-11-2020 2/2 prosecution party in a drunken state entered into the house of the petitioners and tried to outrage the modesty of their Nanad. Petitioners are in custody since 12.03.2020.
Considering the fact that there is general and omnibus allegation against the petitioners and they are ladies having no criminal antecedent, the Court is inclined to grant bail to them. The petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Sahebpur Kamal P.S.
