The petitioner seeks bail in connection with Barachatti P.S. Case No. 309 of 2016 registered for the offence under Sections 47(a)/48(2)/63 of the Bihar Prohibition and Excise Act and Section 272 and 273 of the Indian Penal Code. Learned counsel for the petitioner submits that the name of the petitioner has transpired in this case on the confessional statement of co-accused without any evidence. Learned counsel for the petitioner also submits that the petitioner is in custody since 22.02.2023.

Patna High Court CR. MISC. No.26664 of 2023(2) dt.23-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise, Court No. 02, Gaya in connection with Barachatti P.S.
