JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2016 Though, this Court has roster of anticipatory bail of 2016, but this application, which is registered in 2015, has been listed in view of the order of Hon'ble the Chief Justice vide order dated 14.03.2016. Heard learned counsel for the petitioners and the State.
Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 379, 427, 506 of the Indian Penal Code. The prosecution case is that on 04.06.2015 at 7.00 O' Clock in the morning the informant was sitting at his house, when petitioners along with other First Information Report named accused persons and five unknown persons came there the started assaulting the informant. The accused
Patna High Court Cr.Misc. No.53032 of 2015 (2) dt.14-09-2016 persons also threw acid upon the informant, as a result his both hands, neck received burn injury. The accused persons also gave life threatening to the informant, damaged the vehicle parked near the house and robbed the articles from the shop along with ornaments worth Rs. 20,000/-. It is submitted by the learned counsel for the petitioners that in the background of land dispute the accusation has been levelled and in fact, the informant received injury with battery water which accidentally fell on the informant.
Keeping in view of the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioners.
Let the learned court below consider the prayer for bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Tarapur P.S. Case No. 62 of 2015, pending in the court of learned Chief Judicial Magistrate, Munger. With the above observation this application is disposed of.
