JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Kadwa (Balia Belon) P.S. Case No. 189 of 2017, registered under Sections 147, 148, 341, 323, 324, 307 and 504 of the Indian Penal Code, pending in the court of Additional Chief Judicial Magistrate-IV, Katihar.
The accusation is that six persons named in the including the petitioners starting digging the ditch in the way of the informant. When the informant made protest then both petitioners caused injury through Farsa and Dabia at the head of informant whereas others also caused injury through fist and slaps.
Patna High Court Cr.Misc. No.38869 of 2017 (3) dt.12-12-2017 As per injury report, the injuries as found on the person of the informant are grievous in nature. Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
