The petitioner apprehends his arrest in connection with Barhat P.S. Case No. 05 of 2016 registered under Section 366A/34 of the Indian Penal Code.

The accusation is that when the daughter of the informant aged about 15 years had gone to attend the call of nature in the night, the petitioner and other accused kidnapped her. On the next morning, the informant made query to Singheshwar Manjhi, father of Jhagru Manji then he told that due to nonfulfillment of demand of money, his daughter has been kidnapped. Learned counsel appearing on behalf of the petitioner submits that there was love affairs between the informant's daughter and Jhagru Manjhi, but the petitioner has

Patna High Court Cr.Misc. No.36500 of 2016 (2) dt.15-09-2016 2/2 falsely been implicated in this case. The victim in her statement recorded under Section 164 Cr. P.C., has stated that she was called by Jhagru Manjhi on 08.01.2016 at 02:00 pm. in Jhajha Station then she reached at Jhajha Station where petitioner and others were present and she boarded in train but Jhagru Manjhi did not perform the marriage. It is further submitted that co-accused Singheshwar Manjhi and Munna Manjhi have already been allowed anticipatory bail by a Bench of this Court vide Cr. Misc. No. 33216 of 2016 on 24.08.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Jamui in connection with Barhat P.S. Case No. 05 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
