JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-10-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State through video conferencing.
The petitioner apprehends arrest in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code.
Petitioner and other accused persons are alleged to have abused and assaulted the informant and his wife with iron rod.
Learned counsel for the petitioner submits that the petitioner is innocent. There is a case and counter case. Earlier petitioner side had filed Taraiya Police Station Case No. 73 of 2020 and to save skin from the said case, informant filed the instant case. It is further submitted that the injuries sustained by the informant and his wife are simple in nature caused by hard and blunt substance. A copy of the injury report is contained in Annexure 2 to the bail petition. It is stated in para 3 of the bail
Patna High Court CR. MISC. No.27218 of 2020(2) dt.21-10-2020 2/2 petition that the petitioner has got no criminal antecedent. In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Saran at Chapra in Taraiya Police Station Case No. 74 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
