The petitioners apprehend their arrest in Sherghati P.S. case No. 227 of 2016 under Section 307 and other Sections of the Indian Penal Code.
The Director of West Link Trading Private Limited Company lodged the case and alleged that petitioners and others came near the site of mining of sands and raised slogans and set ablaze different vehicles of the company causing loss of about three crores.
The learned senior counsel for the petitioners submits that for the same occurrence three cases were lodged. One from the side of petitioners and another by the police and third case was
Patna High Court Cr.Misc. No.41169 of 2016 (3) dt.28-10-2016 2/2 lodged by the Director of the company. Many persons named in the FIR have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 44477 of 2016 and on that ground some of the persons named in the FIR have also been granted anticipatory bail vide order passed in Cr. Misc. Nos. 38419 of 2016 and 41697 of 2016. The case of the petitioners stands on the same footing. Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in Sherghati P.S. Case No. 227 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
