The petitioner apprehends his arrest in connection with Giriyak (Katrisarai) P.S. Case No. 17 of 2017, registered under Section 302/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Nalanda at Bihar Sharif. The accusation is that petitioner along with Lalan Kumar reached at the door of Chandra Shekhar Prasad, uncle of the informant, and started to abuse him on pointing the pistol saying to execute the sale deed in respect of his land. When Chandra Shekhar Prasad made protest then he was dashed from stair and sustained injury at his head. Thereafter, he was rushed to
Patna High Court Cr.Misc. No.19561 of 2017 (5) dt.26-07-2017 Sadar Hospital, Biharsharif, where he died.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
