JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Spl. (POCSO) Case No.14 of 2020 arising out of Nauhatta (Nawahatta) P.S. Case No. 105 of 2019 for the offence under Section 376/34 of the Indian Penal Code. Subsequently, charge sheet has been submitted for the offence under Section 376 of the IPC and Section 4 of the POCSO Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 31.01.2020.

Considering the nature of allegations and gravity of offence against the petitioner, the Court is not inclined to grant bail to him. Prayer for bail is rejected.

In the event trial is not concluded within the stipulated time, the petitioner may renew his prayer for bail.
