Heard learned counsel for the petitioner and learned APP for the State.
The petitioner is apprehending his arrest in a case registered under Sections 420 and 409/34 of the Indian Penal Code.
The prosecution case, in brief, is that co-accused Brijnandan Sharma had not produced the folders of educational certificates and other records of three appointed panchayat teachers before Vigilance Investigation Bureau for its verification and the petitioner was also involved in the alleged offence. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of
Patna High Court Cr.Misc. No.41915 of 2016 (4) dt.16-12-2016 2/2 tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner had joined as Panchayat Secretary of the concerned Panchayat in the year 2012 and subsequently superannuated in the year 2015. Vide Annexure-3 to the supplementary affidavit he had complained to the Block Education Officer that his predecessor has not handed over the charge along with the documents relating to the appointment of the panchayat teachers. Same is dated 4.1.2013.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, the provisional bail granted to the petitioner by order dated 25.10.2016 in connection with Karpi P.S. case No.110 of 2016 pending in the court of the Chief Judicial Magistrate, Arwal is hereby confirmed.
Application stands disposed of.
