JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Nasariganj Rajpur P.S. Case No. 67 of 2017, registered under Sections 384, 385, 386, 395 and 307/34 of the Indian Penal Code. The accusation is that the construction work was being done by the Bihar State Building Construction Corporation Limited under the contract of the informant. Sudama Yadav along with his wife-petitioner, Jila Parishad of Rohtas, came on the spot and asked to Munsi to stop the construction work and also asked to meet the contractor to them. Thereafter, Sudama Yadav, husband of the petitioners, talked on mobile and demanded ransom in the night of 21/22.04.2017. Thereafter, Sudama Yadav

Patna High Court Cr.Misc. No.36743 of 2017 (3) dt.21-09-2017 and others named in the F.I.R. and some unknown came at the site and started firing, in which, several labourers and Munsi sustained injuries.

Learned counsel for the petitioners submits that it would appear from the F.I.R. that the allegation of demanding the ransom is against Sudama Yadav, husband of the petitioner, with further allegation to reach on spot with his associates and making firing. But the petitioner being the wife of Sudama Yadav, has falsely been implicated in this case.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rohtas, Sasaram, in connection with Nasariganj Rajpur P.S. Case No. 67 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
