The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147, 149, 341, 323, 307, 504, 506 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Accusation against the petitioners is of making brutally assault to the informant.

It is submitted by learned counsel for the petitioners that for the occurrence of 04.07.2015, the fardbeyan was recorded on 08.07.2015 which came to be registered as police case on 29.07.2015 and at earlier point of time the petitioners' side lodged

Patna High Court Cr.Misc. No.53434 of 2015 (2) dt.24-11-2015 2/2 Ahiyapur P.S. Case No.591 of 2015 on 06.07.2015 against the informant and others. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the delayed lodging of the case and the case lodged by the petitioners' side at earlier point of time constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Ahiyapur P.S. Case No.651 of 2015, pending before the learned CJM, Muzaffarpur. With the above observation, this application is, accordingly, disposed off.
