21-10-2020 Heard counsel for the petitioner and State through video conferencing.
The petitioner apprehends his arrest in Amas P.S. Case No. 3 of 2020, registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.
350 liters of foreign liquor has been recovered from a Tata Indigo and one co-accused Dhanraj Kumar was arrested, who disclosed that said liquor belongs to petitioner and one Upendra Singh.
It is submitted on behalf of petitioner that petitioner has been named in this case on the basis of confessional statement of co-accused, whereas nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of said vehicle (Indigo car). The

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court, Gaya in connection with Amas P.S. Case No. 3 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J.) anay/- U T
