The petitioner is apprehending his arrest in a case registered under Section 302/34 of the Indian Penal Code. The prosecution case, in short, is that on 4.6.2017 at 3.30 P.M., Anil Singh, brother of the informant, went to meet someone on his motorcycle and at 11.30 P.M. one Santlal Sah informed the informant that Anil Singh laying near the house of Krishna singh, on which the informant and others went there and found his brother in an injured condition and brought him to Hospital, where he died.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court Cr.Misc. No.45485 of 2017(2) dt.22-09-2017 2/2 petitioner has been made accused merely on the basis of suspicion. There is no other substantive evidence to suggest his implication in the present case nor there is any eye witness to the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Saran, Chapra in connection with Maker P.S. case No.87 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
