The petitioner apprehends his arrest in Bahera P.S. Case No. 01/2016, registered for the offences punishable under Sections 436, 387 and other sections of the Indian Penal Code. The informant alleged that petitioner Murari Jha and Shishir Kumar Jha came to his house demanded extortion of Rs. 1,000/- for taking liquor. The accused persons threatened to set ablaze the house in case of non-payment of extortion. It is further alleged that in the night he woke up hearing the sound of crying and saw the petitioner and Shishir Kumar Jha fleeing away. His house was burning. Many articles were turned to ashes. Learned counsel for the petitioner submits that nobody has seen the petitioner setting ablaze the house of the informant.

No.45609 of 2016 (2) dt.24-11-2016 2/2 The informant got enmity with the petitioner, but from perusal of the record it appears that petitioner was seen fleeing away along with the accused person from the place of occurrence. Similarly, situated co-accused has been granted regular bail. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
