The petitioners apprehend their arrest in connection with Nabinagar P.S. Case no. 100 of 2017, registered under Sections 341, 323, 307, 427 and 504/34 of the Indian Penal Code. The accusation is that on 18.04.2017 informant had gone in Barat of son of his brother-in-law, where some boys who were in drunken condition came near his vehicle, where Nikhil Kumar, son of the informant was present. Thereafter, one boy asked key of the vehicle then Nikhil Kumar refused to give key due drunken state of the boys and due to that reasons, hot talks were started. At that time, petitioner No. 2 Rajesh Singh and petitioner No.3 Bablu Singh damaged the glass of the vehicle. On protest made by his son Nikhil
Patna High Court Cr.Misc. No.42481 of 2017 (2) dt.20-09-2017 2/2 Kumar, petitioner No.4 Anuj Singh and others ordered to kill him then petitioner Nos.2 and 3 caused injury at the head of Nikhil Kumar, son of the informant as well as informant.
Learned counsel for the petitioners submits that the injuries as found on the person of the informant and his son are simple in nature. Further submission is that, in fact, due to quarrel in Barat the occurrence of Marpit took place in which petitioner's side also sustained injuries. The petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S. Case No. 100 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
