Learned counsel for the petitioner is directed to remove the defect(s) as pointed out by the office within a period of four weeks.

The petitioner is apprehending his arrest in a case registered under Sections-419, 467, 468, 471 of the Indian Penal Code.

Prosecution case in short is that on 17-07-2021, BSSC Typing Test Examination was going on at ION Digitgal Zone, IDS, Patliputra, Patna and during Hall Ticket and Id card verification of the candidates, on suspicion one examinee was apprehended, who disclosed his real name as Lalu Kumar Yadav @ Lucky Kumar and he further confessed that he is appearing in the said examination on behalf of his friend/accused-petitioner.

There is no allegation of tampering of witnesses is alleged against the petitioner. The petitioner has no knowledge regarding the alleged incident. The petitioner had no concern with the co-accused who is said to have been apprehended on the spot. The name of the petitioner has transpired in this case on the basis of disclosure made by the coaccused. Learned counsel for the State submits that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the petitioner named above, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Arvind Kumar Das, learned Additional Chief Judicial Magistrate-X, Patna in connection with Patliputra P.S. Case No. 348 of 2021 subject to the conditions as laid down under Section-438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) A.K.V.//- U T
