The petitioner apprehends his arrest in connection with Kasba P.S. Case No. 11 of 2015 registered for the offences punishable under Sections 406,407, 409, 420, 467, 468, 471/120(B) of the Indian Penal Code and Section 7 of the E.C. Act.

Despite repeated adjournments, the Bihar State Food Corporation is unable to bring on record any further documents as has been prayed by him earlier. Vide order dated 01.10.2015, this Court after hearing the matter has extended the privilege of interim relief to the petitioner.

In view of certain discrepancies and grey areas in the prosecution and the facts and circumstances of the case, let the

Patna High Court Cr.Misc. No.14234 of 2015 (8) dt.09-11-2015 petitioner above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Kasba P.S. Case No. 11 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

It is made clear that the petitioner shall present himself at all appointed dates in the Court below so as to facilitate the prosecution. In case, the petitioner makes himself absent in the Court below on two consecutive dates without any reasonable cause, it shall be open for the Court below to reconsider this order and to take appropriate steps in accordance with law. The Bihar State Food Corporation shall also be at liberty to file any application as and when so required for modification/cancellation of the order in case the petitioner fails to adhere to the directions herein.
