The petitioner apprehends his arrest in connection with Ramgarh P.S. Case No. 164 of 2016 registered under Sections 147, 149, 341, 323, 325, 354, 504 and 506 of the Indian Penal Code.

The allegation of informant Poonam Devi is that on 26.07.2016, when she was present at her field along with her family members then petitioner along with his both sons Shamu Singh, Kameshwar Upadhyay, mother, wife and daughter reached there and started to abuse. When the informant made protest then the petitioner gave lathi blow at the hand of her mother-in-law Thagni Devi, who fell down. When she rushed to save her,

Patna High Court Cr.Misc. No.44366 of 2016 (2) dt.22-10-2016 2/2 mother-in-law then she was also assaulted.

Learned counsel appearing on behalf of the petitioner submits that in fact, the land as detailed in the F.I.R. belonged to the petitioner, but the informant and others tried to cultivate the same then occurrence of mar-pit took place, in which wife of the petitioner and mother also sustained injury regarding which Ramgarh P.S. Case No. 163 of 2016 was also instituted under sections 147, 149, 341, 323, 354, 379 and 504 of the I.P.C. While three injuries were found on the person of mother-in-law of the informant, but the opinion was kept reserved. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Kaimur at Bhabua in connection with Ramgarh P.S. Case No. 164 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
