Petitioners apprehend arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379, 380 and 504/34 of the Indian Penal Code.
As per the prosecution case, on the alleged date and time, F.I.R. named accused persons encircled the informant and
Patna High Court CR. MISC. No.27211 of 2020(3) dt.12-11-2020 2/3 assaulted him when he was returning to his home from his tea stall. It is further alleged that Vinod Chauhan gave Farsa blow on the head of the mother of the informant and the accused persons also assaulted the family members of the informant by Lathi and Danda. It is further alleged that accused Rohit and Rahul entered into the house of the informant and took away gold chain, ear ring of the wife of the informant and Rs. 5,600/-. It is submitted on behalf of the petitioners that there is general and omnibus allegation against the petitioners and petitioners have falsely been implicated in this case. Specific overtact is alleged against co-accused Vinod Chauhan who is not the petitioner in this case.
It is further alleged that there is no such occurrence of looting has taken place. It is stated by learned counsel for the petitioners in paragraph 3 of the bail petition that petitioners have got no criminal antecedent. In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. In the event of arrest/surrender, let the petitioners mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in Kateya Police Station Case No.
