The petitioner seeks bail in Bandeya P.S. Case No. 20 of 2020, registered for the offence punishable under Sections 366(A), 504 and 34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. The victim girl (daughter of informant) in her statement under Section 164 has stated that she voluntarily left her house and went along with this petitioner and also got married with him in a temple in Kolkata. They are living in a rented house. The medical board has assessed her age to be 17-18 years. Petitioner is in custody since 14.01.2021 having clean antecedent.

In view of statement of victim girl under Section 164 Cr.P.C, the petitioner above-named, is directed to be enlarged

Patna High Court CR. MISC. No.35254 of 2021(2) dt.08-12-2021 2/2 on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge VI-cumSpecial Exclusive Judge (POCSO), Aurangabad in connection with Bandeya P.S. Case No. 20 of 2020.
