Heard the learned counsel for the petitioner and learned APP for the State.

Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Khagaria (Muffasil) P.S. Case No. 711 of 2021 registered for the offence

Patna High Court CR. MISC. No.27571 of 2023(2) dt.15-05-2023 2/3 under Sections 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 15.02.2023 and there is recovery of 2934 liters of illicit liquor.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Special Judge Excise, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 711 of 2021. The petitioner will visit Rajapakar Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

Case No. 711 of 2021 registered for the offence under Sections 30(a) of Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner has no concern with the alleged seized liquor or the alleged contained from which the recovery was made and he is falsely implicated in the case at the instance of the police only on suspicion.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the submission of learned counsel for the petitioner and also considering the period of custody, this application for regular bail is allowed.
