The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 413 and 414/34 of the Indian Penal Code. Theft was committed in a shop at Kanaught Place, New Delhi on 03.09.2014 leading to arrest of Santosh from whom three suspected stolen Rolex watches were recovered. Santosh disclosed that he used to sell the stolen articles to petitioner no. 1 and one Munna. It also transpired that petitioner no. 2 is the member of the gang which used to commit theft at Kanaught Place.

Patna High Court Cr.Misc. No.51125 of 2015 (2) dt.09-11-2015 2/2 It is submitted by learned counsel for the petitioners that except the suspicion there is nothing against these petitioners. There is no recovery from these petitioners. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

It appears from the record that Santosh Kumar from, whom recovery has been made, has been granted regular bail vide Cr. Misc. No. 10812 of 2015. This Court sees no reason for learned court below not to consider the prayer for regular bail of the petitioners,, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Ghorasahan (Jitua) P.S. Case No. 382 of 2014 pending in the court of learned Sub-divisional Judicial Magistrate, Sikarahana at Motihari.

With the aforesaid observation, this application is disposed of.
