The petitioner apprehends his arrest in connection with Shikarpur P.S. Case No. 409 of 2018 registered for the offence punishable under Sections 147, 447, 354, 354(B), 323, 324, 509, 504/34 of the Indian Penal Code.

Petitioner along with other accused persons intruding into the house of the informant in his absence assaulted his daughter by means of leg and fist. Responding hulla, when the informant and his wife rushed there, her daughter divulged him that the petitioner was making indecent remark and comment upon her and also extended threatening in case of divulgence of the occurrence to anyone.

Patna High Court CR. MISC. No.25559 of 2019(2) dt.25-04-2019 2/2 It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case at the instance of nephew of the Ex-Mukhiya in collusion with Circle Officer, Narkatiyaganj by the informant, who is said to be man of Ex-Mukhiya, namely, Anil Rai. The informant has lodged this false and frivolous case against the petitioner in order to save his skin from Shikarpur P.S. Case No. 410 of 2018 lodged by the father of co-accused against the informant and others.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 409 of 2018, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
