On consensus having been arrived between parties, this writ application is being disposed of with a direction to the District Magistrate, Bhojpur to take a decision upon the issue raised by the petitioner that she should have been appointed in place of respondent no. 5, Smt. Vimla Singh, as she is permanent resident of village Suarmarva, P.S. Maner, District Patna but she had been appointed as Aganwari Sevika at Village Anaith, District Bhojpur against all the guidelines and instructions issued in this regard.
Patna High Court CWJC No.17888 of 2008 dt.02-11-2017 2/2 Let this matter be decided accordingly after hearing the petitioner as well as the respondent no. 5 within a period of one month from the date when the parties would appear before the District Magistrate concerned.
The petitioner and the respondent no. 5 would be at liberty to raise all the grievances which would be available to them. The petitioner would also be at liberty to raise all the grounds which have been raised before this Court in the present writ petition.
Let both the parties appear before the District Magistrate, Bhojpur at Ara on 23rd November, 2017. Thereafter, a firm date would be fixed by the District Magistrate in Misc. Case No. 37 of 2010-11 and appropriate decision on its own merit and in accordance with law should be taken by him within a period of one month thereafter and the same should be communicated to both the sides.
