The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of causing firearm injury to Udeshwar Yadav.

The Doctor has found lacerated wound at the chest and another at the parietal region of Udeshwar, simple in nature. The cause of injury is not mentioned in the medical report. Hence, the eye-witness cannot be disbelieved at this stage. Therefore, considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on

Patna High Court Cr.Misc. No.42798 of 2017 (2) dt.22-09-2017 2 /2 anticipatory bail in connection with Bhagwanganj P.S. Case No. 92 of 2015 pending in the court of learned Judicial Magistrate, 1st Class, Masaurhi/successor court.

Accordingly, prayer for bail is refused.
