Petitioner is apprehending his arrest in Ekma P.S.Case No.142 of 2017 registered for the offences under Sections 147, 149, 341, 323 and 307 of I.P.C.
Allegation against the petitioner is of assault and also wrapping towel in the informant.
Submission of the learned counsel for the petitioner is that all the injuries are simple in nature and there is case and counter case between the parties.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a
Patna High Court Cr.Misc. No.3923 of 2018 (2) dt.02-02-2018 2/2 period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 1st , Saran at Chapra, in Ekma P.S.Case No.142 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the investigation of the case and make himself available as and when required by the police, otherwise, the prosecution is free to move for cancellation of his bail bond.
