JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 05-10-2018 The matter was earlier listed for admission but no one appeared on behalf of the petitioner. In order to facilitate the counsel for the petitioner to assist the Court, today the case has been listed under the heading for dismissal but unfortunately today also no one has appeared in the instant case to assist the court. Under the compelling circumstances, the Court is constrained to decide the writ application on the basis of material available on the record.
In the present writ application, petitioner has claimed
Patna High Court CWJC No.22213 of 2014 dt.05-10-2018 2/2 that he should be granted exemption in appearing National Eligibility Test (NET), as petitioner has possessed M.Phil. Degree.
In view of judgment of the Apex Court in the case of P. Suseela & Ors. vs. University Grants Commission & Ors. reported as 2015(3) PLJR 278 (SC), the Court does not find any merit in the contention of the writ petitioner. Accordingly, the instant writ application is dismissed.
