The petitioner was granted provisional anticipatory bail on readiness that he is ready to keep the complainant as wife with full dignity and honour and statement to that effect has been made in paragraph 11 of the main petition, which reads as follows: - "That be that as it may, the petitioner has no grievance against his wife, and he, however, undertakes before the Hon'ble Court to keep his wife with full dignity and honour, respect and comfort, safety and security" but now the

Patna High Court Cr.Misc. No.55432 of 2015 (2) dt.16-12-2015 2/2 stand of the petitioner has changed and now he is ready to make payment of maintenance or permanent alimony.

Considering the statement of the petitioner, this Court is not inclined to entertain such prayer for modification of order dated 04.09.2015 passed in Cr. Misc. No. 39273 of 2015. Let the learned court below consider the prayer for regular bail of the petitioner, if he surrenders before the learned court below in connection with Complaint Case No. C218 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Sadar, East Champaran at Motihari. Accordingly, this modification application is disposed of.
