JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05/ 16.11.2016 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners happen to be parents-in-law of the deceased and apprehend their arrest in connection with a case registered under sections 302, 328 and 201 of the Indian Penal Code.

Informant expressed his doubt against the petitioners and husband of the deceased that deceased might have poisoned to death by petitioners and their family members but submission on behalf of the petitioners is that deceased had solemnized her love marriage with the son of the petitioners and, as a matter of fact, she died of her ailment and subsequently, her dead body was cremated in presence of several persons. It is also informed that husband of the deceased

Patna High Court Cr.Misc. No.36614 of 2016 (5) dt.16-11-2016 has already been remanded in this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Ara Town P.S. Case no. 334/2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
