Permission is accorded.

Application filed on behalf of petitioner No.1 is dismissed as withdrawn.

Heard learned counsel for the petitioner Nos.2 to 4 and learned APP for the State.

The petitioner Nos.2 to 4 are apprehending their arrest in a case registered under Sections 341, 323, 354, 379 and 504/34 of the Indian Penal Code.

Allegation is that accused persons including the petitioners assaulted the informant and snatched his golden chain and Rs.10,000/- from the pocket and they also tried to outrage the

Patna High Court Cr.Misc. No.45466 of 2017(2) dt.22-09-2017 2/2 modesty of the informant's sister.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioner have falsely been implicated in the present case. The main allegation is against co-accused, namely, Vikash Kumar Singh and Manish Singh for committing an offence under Section 379 of the I.P.C.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner Nos.2 to 4, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in connection with Kudra P.S. case No.90 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
