The petitioner has preferred this application for grant of regular bail in a case registered under sections 379 and 411 of the Indian Penal Code.
As per the prosecution case, the informant's motorcycle was stolen from his house.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession
Patna High Court CR. MISC. No.26882 of 2022(2) dt.31-08-2022 2/2 of the petitioner. The petitioner is accused in two other criminal cases as stated in para 3 of the bail petition. The petitioner is not named in the F.I.R. and the name of the petitioner has sprung up in the confessional statement of the co-accused Mithun Kumar. The said motorcycle was recovered from the possession of the co-accused Mithun Kumar. The petitioner is in custody since 06.03.2022.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the nature of allegation against the petitioner, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia, in connection with Krityanand Nagar P.S. Case No. 498 of 2021.
The application stands allowed.
