The petitioner is apprehending arrest in a case registered for the offences punishable under sections 447,448,379,354A and 506/34 of the Indian Penal Code. The prosecution case is that the informant at 11.45 P.M. on 5.5.2015 woke up on some noise and found that this petitioner was trying to drag the daughter of the informant, on protest being made the petitioner escaped from the scene but fifty thousand rupees and jewellery were found missing. Earlier also a case of kidnapping was lodged against the petitioner. It is submitted by the learned counsel for the petitioner that the daughter of the informant was in love with the

No.51191 of 2015 (2) dt.09-11-2015 2/2 petitioner and for the same earlier case was lodged making accusation under section 366A IPC wherein the petitioner was granted bail by Juvenile Justice Board and as a retaliatory measure the present case has been lodged. It is further submitted that there is no recovery from the petitioner.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Beldaur P.S. Case No. 101 of 2015 pending in the court of learned JM Ist Class, Khagaria. This application is disposed of with the aforesaid observation/direction.
