Mr.Akhileshwar Dayal, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 15-10-2020 Learned counsel for the petitioner undertakes to remove the defects, if any, within four weeks after start of normal functioning of the Court.
After some argument, learned counsel for the petitioner could realize that this application is totally misconceived and it would not be an exaggeration if this Court calls it a frivolous application. The application for anticipatory bail of this petitioner was rejected earlier on 19.12.2019 giving specific consideration to all the materials on the record. Still second attempt has been taken after ten months without showing any change of circumstance as is required to be shown and in fact no statement to that effect has been made in the second petition which is contrary to the direction of this court in the
Patna High Court CR. MISC. No.27039 of 2020(2) dt.15-10-2020 2/2 case of Bablu Singh @ Banhkatta Vs. the State of Bihar reported in 2017(3) PLJR 499 which has now been notified as a rule.
For the aforesaid reasons, this Court intended to impose some heavy cost but finding that the learned Advocate who has been sent to argue the matter is a new entrant at the Bar, this Court has restrained itself from imposing the cost. This application is dismissed.
