JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Moffasil P.S. Case No. 289 of 2016 registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. The accusation is that petitioners and one Lalji Prasad Bagat reached near the informant due to land dispute and made some query about making interference regarding selling of the land and started abusing. When the informant made protest then petitioner no. 2 Sashikant Kumar @ Maikal caused injury through knife on his head and petitioner no.1 Rajendra Prasad caused injury through rod to the informant, who was rushed to Sadar Hospital for treatment.

Patna High Court Cr.Misc. No.53269 of 2016 (2) dt.08-12-2016 2/2 Learned counsel appearing on behalf of the petitioners submits that the petitioners are gotia of the informant and due to land dispute, earlier petitioners' side also received injury regarding which Moffasil P.S. Case No. 286 of 2016 was lodged by the petitioner no.1, Rajendra Prasad. Due to that reason, the present case has been lodged. Moreover, three injuries, as found on the person of the informant, are of simple in nature. Further submission is that petitioners have no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Saran in connection with Moffasil P.S. Case No. 289 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
