JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 27-07-2016 Prayer of the petitioner for a direction upon the Bihar State Bar Council to consider the claim of the petitioner for appointment on a Class III post of an Assistant on compassionate ground cannot be ordered at this juncture by the Court, for the simple reason that the elected body has been superseded and ad hoc committee has been put in place by the All India Bar Council and they are saddled with the responsibility of running day to day affairs like a care-taker government awaiting constitution of a regular one. The Court is of the opinion that the ad hoc committee cannot be compelled to take a policy decision which has a long term implication for the statutory body.

Patna High Court CWJC No.18711 of 2015 dt.27-07-2016 Writ application is dismissed with an observation that as and when the Bar Council is constituted after due election of its members and office bearers, petitioner can raise the issue before them, who will take a decision in accordance with law.
