The petitioner apprehends his arrest in Mahila (Gaya) P.S. Case No. 01 of 2020, registered for the offences punishable under Sections 354(D), 420, 376 and 509 of the Indian Penal Code.

Prosecution case in brief is that petitioner took nude photographs of the informant by intoxicating her. It is further alleged that this petitioner took money of Rs. 4.5 lakh from the informant and sexually assaulted her several times. Petitioner also threatened the informant to make viral her nude photographs on social media.

It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case. The present FIR has

No.27203 of 2020(5) dt.19-01-2021 2/2 been lodged by the informant only to extort money and petitioner has deposited certain money in the account of informant and in support of the same, some papers has also been annexed. In fact, both of them were living together and when the petitioner refused to marry the informant, this false case has been lodged. Petitioner has got no criminal antecedent, as stated in para 3 of the petition.

However, counsel for the State vehemently opposed the prayer for bail and submitted that there is specific allegation that he took nude photograph of the informant and also threatened to make viral on social media.

Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
