JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-10-2020 Heard Mr. Ashok Kumar Jha, learned counsel for the petitioner and Mr. Humayou Ahmad Khan, learned counsel appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Dhaka P.S. Case No. 143 of 2019 registered for the offence under Section 392 of the I.P.C.

The prosecution story as per the First Information Report is that while the informant was going on his motorcycle, he was intercepted by 03 miscreants riding on a motorcycle and they snatched away the motorcycle of the informant as well as cash of Rs. 6,700/-, mobile phone, PAN Card, ATM Card etc. Learned counsel for the petitioner submits that petitioner is not named in the First Information Report. Case No. 112 of 2019 was registered in which the petitioner remained in custody since 20.05.2019 and was granted bail by this court on 18.07.2019.

Having heard learned counsel for the parties and taking into consideration the materials available on record, I am not inclined to grant regular bail to the petitioner at this stage. Accordingly, the prayer for grant of regular bail stands rejected.

However, the petitioner may renew his prayer for bail after six months if the trial does not show any progress. (Anil Kumar Sinha, J) praful/- U T
