Petitioners apprehend their arrest in connection with Warsaliganj P.S. Case No. 10 of 2016 registered under Section47(A) of the Excise Act. Fifteen litres each country-made liquor was recovered from possession of petitioner Nos. 1 & 2 whereas; 20 litres country-made liquor was recovered from possession of petitioner No. 3.
Submission on behalf of petitioners is that the present case was lodged before coming into force of new amended Excise Act and moreover, one co-accused, namely Brahmdeo Paswan has already been granted privilege of anticipatory bail by a coordinate bench of this court vide order dated 03-05-2016
Patna High Court Cr.Misc. No.43505 of 2016 (2) dt.30-11-2016 2/2 passed in Cr. Misc. No. 17280 of 2016.
Considering the aforesaid facts and circumstances as well as submission of the parties, this anticipatory bail petition stands disposed off giving direction to petitioners to surrender before the court below within four weeks from the date of receipt/production of copy of this order and, if, they do so, the learned court below shall pass appropriate order on regular bail application of the petitioners on the day of their surrender itself.
