JUSTICE ARUN KUMAR ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Haveli Kharagpur P.S. Case No.213 of 2017 registered under Section 7 of the Essential Commodities Act.

Allegation is that 85 bags of wheat and 90 bags of rice, food grains of the scheme of National Food Security Programme, was recovered from the rice mill of the petitioner. It is submitted by learned counsel for the petitioner that paddy was supplied to the petitioner by Marketing Officer in case of closure of a rice mill of another miller and the wheat was of different farmers kept in his godown and they have applied for release of the wheat and this petitioner has got no criminal antecedent.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.50102 of 2017 (2) dt.18-10-2017 2 /2 circumstances, let petitioner, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Munger in connection with Haveli Kharagpur P.S. Case No.213 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
