The petitioner apprehends his arrest in connection with Kotwali (Barari) P. S. Case No. 192 of 2017 registered for the offences under Sections 409, 420, 468, 469, 471/34 of the Indian Penal Code.

Allegedly, in the Bus No. BR11C-4312 the petitioner was the driver and during checking it was found that forged tickets were sold to the passengers causing loss to the government revenue.

Submission is of false implication and that the petitioner was the driver of the said bus. Conductor was Mahendra Prasad Singh. Similarly situated co-accused Mukesh Kumar Singh and Mahendra Prasad Singh have already been allowed pre-arrest bail vide Cr. Misc. no. 41294 of 2017 and 30346 of 2017

Patna High Court Cr.Misc. No.44041 of 2017(2) dt.19-09-2017 2/2 respectively by another co-ordinate Bench of this Court and as such the petitioner being driver also deserves sympathetic consideration.

Learned APP fairly submits that the conductor of the Bus namely, Mahendra Prasad Singh has already been allowed prearrest bail. In the facts and circumstances of the case, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kotwali (Barari) P. S. Case No. 192 of 2017, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
