JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-10-2020 Heard Mr. Randhir Kumar No. 1, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Begusarai Muffasil P.S. Case No. 519 of 2019 dated 08.10.2019 instituted for offence under Sections 302, 201 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The nephew of the informant was found murdered and his dead body was lying behind one cold storage.

No.26945 of 2020(2) dt.19-10-2020 2/3 Because the deceased used to oppose the illegal sale of liquor by named accused persons, therefore, the informant suspected their hands in the murder of the deceased. The petitioner is not named in the F.I.R. and no suspicion also has been raised against him. However, when the petitioner and another were arrested in an Arms Act case, they were made to confess before the police that they had participated in the occurrence. Apart from the aforesaid confession by the petitioner, there is no other material to connect the petitioner with the offence. The petitioner has been remanded in this case on 30.11.2019. One of the accused persons of this case, namely, Aman Kumar has been enlarged on bail by a Bench of this Court vide order dated 18.03.2020 passed in Cr. Misc. No. 84836 of 2019.

Regard being had to afore-stated facts, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai,
