2. The petitioner makes a prayer for bail in connection with Jokhihat P.S. Case No. 339 of 2025 F.I.R dated 12.10.2025 registered for the offences punishable under Sections 317(4), 178 of BNS and Section 25(1-b)a, 26 and 35 of Arms Act.
3. As per the prosecution case, on 12.10.2025, during investigation of Jokihat P.S. Case No. 338 of 2025, the informant along with police team traced the involvement of the accused persons, Zahid and Rozid, through technical and CCTVs analysis. It is alleged that both accused were identified by the chowkidar and their mobile location was tracked, following which a raid was conducted. During the raid, Md.
Patna High Court CR. MISC. No.25418 of 2026(3) dt.13-05-2026 2/3 Zahid was found in possession of a pistol, cartridges, and cash, while further recovery of cash was made from the house of Rozid. Both accused were arrested and seizure lists were prepared.
4. Learned counsel for the petitioner submits that petitioner is innocent, has committed no offence and has falsely been implicated in this case. Counsel for the petitioner submits that petitioner was initially taken into police custody in Jokihat P.S. Case No. 338 of 2025 on 13.10.2025 and thereafter petitioner has been made accused in the instant case. Thereafter, he was remanded in the present case on 29.10.2025. The case of the petitioner is that during the course of investigation, it has been alleged that one pistol and magazine along with two live cartridges were recovered. Nothing incriminating has been recovered from the constructive possession of this petitioner. Petitioner is in no way connected with the instant case and on such identification by the chaukidaar, the petitioner was taken into custody on 13.10.2025 in Jokihat P.
S. Case No. 338 of 2025 thereafter have been implicated in the present case. Petitioner is in languishing in judicial custody since 29.10.2025 and the police have submitted charge-sheet.

5. Learned Additional Public Prosecutor for the State opposes the prayer for regular bail.

Considering the facts and circumstances, the period of custody and that the similarly situated co-accused person has been granted bail by a Co-ordinate Bench of this Court, the petitioner is enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokhihat P.S. Case No. 339 of 2025, subject to the condition that the petitioner shall cooperate in the investigation/trial. Abhishek/- (Ajit Kumar, J) U T
