This application for regular bail arises out of Dhanarua P.S. Case No. 168 of 2018, disclosing offence punishable under Sections 302, 34 of the Indian Penal Code. The petitioner is elder brother of the husband of the deceased. The deceased was married nearly 10 years before the date of her death. The brother of the deceased is the informant, who has alleged that there has been persistent demand of dowry by the in-laws of the deceased including this petitioner and since the demands were not fulfilled, she has been killed. Learned counsel appearing on behalf of the petitioner has submitted that he has been implicated only because he is elder brother of the husband of the deceased and there is no
Patna High Court CR. MISC. No.26915 of 2020(2) dt.19-10-2020 2/2 specific allegation of any demand of dowry or any other overt act against the petitioner. Statements have been made to convince this Court that the petitioner was living separately from the family of the husband of the deceased. It appears that in similar circumstance other family members have been allowed anticipatory bail by this Court by an order dated 21.08.2019, passed in Cr. Misc. No. 24840 of 2019. The petitioner is in custody since 22.05.2018. Considering the above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned SDJM, Masaurhi, in Dhanarua P.S.
