The petitioner seeks bail in connection with Men/Main P.S. Case No. 84 of 2022 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 28.03.2023 and there is recovery of 178.875 litres of foreign liquor from his possession and he has one antecedent.

Learned APP has vehemently opposed the prayer of bail.

Considering the period of custody and recovery of

Patna High Court CR. MISC. No.28008 of 2023(2) dt.15-05-2023 2/2 liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court No. 02, Gaya in connection with Men/ Main P.S.
