JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Lodipur P.S. Case No.130 of 2018 for the offence under Sections 307, 326, 302 and 120B of the Indian Penal Code and Sections 3, 4 and 5 of the Explosive Substances Act. Learned counsel for the petitioner submits that the petitioner is in custody since 22.12.2019.

Considering the fact that there is specific allegation against the petitioner, the Court is not inclined to grant bail to him. Prayer for bail is rejected.

However, the court below is directed to expedite the trial and conclude the same positively within one year from the date of receipt/communication of a copy of this order.

Patna High Court CR. MISC. No.22553 of 2020(3) dt.05-02-2021 2/2 Senior Superintendent of Police, Bhagalpur is directed to ensure the production of all the prosecution witnesses for their examination so that the trial may be expedited within the time frame as indicated hereinabove.
