This is a petition for grant of anticipatory bail for offence under Sections 341, 342, 323, 504, 506, 307, 379 and 34 of the Indian Penal Code.

There is matrimonial relation between the two families and both sides have lodged cases against each other. Both sides sustained injury.

Allegation against the petitioners is of commission of assault. Specific allegation against petitioner, Sarfaraj Ansari, is that he caused injury with dabia at the head of the brother of the informant.

Considering the fact that the petitioner, Sarfaraj Ansari, had knowledge that his act might cause death, I am not inclined to grant anticipatory bail to him.

The prayer for anticipatory bail on behalf of Sarfaraj

Patna High Court Cr.Misc. No.36240 of 2017 (2) dt.10-08-2017 2/2 Ansari is refused.

There is general and omni bus allegation against other petitioners, namely, Merajuddin Ansari, Lookman Ansari and Ahshan Ansari, they, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Karakat P.S. Case No. 149 of 2016 to the satisfaction of the Subdivisional Judicial Magistrate, Bikramganj, Rohtas at Sararam, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
