The petitioner apprehends his arrest in Jamhore P.S. Case No.38 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The S.I. of Jamhore P.S. got information that the petitioner had kept liquor on the roof of his house and on such information, a raid was conducted. 14 bottles of wine each containing 300 ml were recovered from the roof of the house of the petitioner.

Learned counsel for the petitioner submits that it is a joint house and the petitioner cannot be held responsible for the recovery of liquor. The seizure list was not prepared in accordance with law and, therefore, the petitioner deserves anticipatory bail.

Patna High Court CR. MISC. No.25561 of 2020(2) dt.14-10-2020 2/2 Perused the record. It appears that on secret information the informant raided the house of the petitioner and recovered 14 bottles each containing 300 ml liquor from the roof of the house of the petitioner but the petitioner was not present.

Having considered the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
