JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-02-2022 Heard Mr. Arun Kumar, learned counsel for the petitioner and Mr. Khurshid Anwar, learned APP for the State. Petitioner seeks regular bail in connection with Kudhani ( Turki O.P.) PS Case No. 667 of 2019 registered for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
53.265 liters of illicit foreign liquor has allegedly been recovered from a hut belonging to the petitioner situated in bamboo clump.
Learned counsel for the petitioner submits that petitioner is not the owner of the bamboo clump and the hut from where illicit liquor has been recovered is situated in an open space and the same is accessible to all and sundry. He
Patna High Court CR. MISC. No.33813 of 2021(3) dt.22-02-2022 2/2 further submits that petitioner is in custody since 18 / 3 / 2021 , no illicit liquor has been recovered from the conscious possession of the petitioner and charge sheet has already been submitted.
Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that petitioner is in custody since 18 - 03 - 2021 and charge sheet has already been submitted, as such, I am inclined to grant regular bail to the petitioner.
Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Kudhani (Turki O.P.)
